1. Introduction

Welcome to SwapIT Mobile. These Terms and Conditions ("T&Cs") govern your use of our mobile application and services. By accessing or using the app, you agree to be bound by these T&Cs. If you do not agree with these T&Cs, you may not use the app.

2. Definitions

• "User" refers to anyone who accesses or uses the app.
• "Service" refers to the functionality provided by the app.
• "Content" refers to any text, images, or other material uploaded or shared by users.

3. Eligibility

• You must be at least 14 years old to use our app. By using the app, you represent and warrant that you meet this age requirement.

4. User Accounts

• To access certain features of the app, you must create an account.
• You are responsible for maintaining the confidentiality of your account information & password and liable for all activities that occur under your account.
• You must immediately notify us of any unauthorized use of your account.
• We reserve the right to terminate your account if you violate these T&Cs.

5. User Responsibilities

You agree to provide accurate and complete information when creating your account and using the app. You must not:

• Post false or misleading information.
• You agree not to use the app for any illegal or unauthorized purposes, including posting any ad for a device obtained by any illegal means.
• Accuracy of the information/content provided is the advertiser's responsibility and SwapIT Mobile will not be held responsible for false claims made by the advertiser.
• Interfere with the security or proper functioning of the app.

6. Listings and Transactions

• When listing an item for sale, you agree to comply with our listing guidelines. Buyers should verify the information/details posted by the seller.
• Listing an item may incur a fee, which will be clearly communicated to you before you post the listing.
• Payments must be made through the app's secure payment system. We do not accept responsibility for any transactions conducted outside of the app.

7. Rights to user information

• SwapIT Mobile reserves the discretion to withdraw any material from the Website without prior notice and to refuse any material posted by a user.

8. No guarantee of increase in advertisers' business

• SwapIT Mobile does not guarantee business from the leads generated. SwapIT Mobile shall not be responsible or liable at all to the user/advertiser if no business or business leads are generated for the advertiser through premium ads on the application. Advertiser understands that SwapIT Mobile only obligation is to place the seller ads on the Website in the manner provided for in these terms.

9. Dispute resolution

• SwapIT Mobile serves only as an enabling platform to connect prospective buyers with sellers and is not an intermediary platform. Buyers should verify the information/details posted by the seller. Any disputes between buyers and sellers must be resolved through mutual agreement.

10. Intellectual Property

• All content and materials in the app are the property of SwapIT Mobile. SwapIT Mobile owns all intellectual property rights in the Website and the service, including without limitation, the design, text, graphics, ads, user uploaded pictures & ad description. SwapIT Mobile is not liable for any infringement of intellectual property rights arising out of materials posted on or transmitted through the site, or items advertised on the site, by end users or any other third parties.
• By uploading content, (including causing content to be posted using our services), you grant us a non-exclusive, worldwide, perpetual (or for the duration of any copyright or other rights in such content), irrevocable, non-exclusive, royalty-free, license to exercise any and all copyright, trademark, publicity, database or other intellectual property rights you have in or to the content in any media. Further, to the fullest extent permitted under applicable law, you waive your moral rights in the content and promise not to assert such rights or any other intellectual property rights you have in the content against us, our sub licensees or our assignees.

11. Privacy

• We collect and use personal data in accordance with our Privacy Policy. Please review the policy to understand our practices.

12. Limitation of Liability

• The app is provided "as is" without warranties of any kind. We do not guarantee that the app will be error-free or uninterrupted. Our liability is limited to the maximum extent permitted by law.

13. Compensation

• You will compensate us in full (and our officers, directors, agents, subsidiaries, joint ventures and employees) for any losses or costs, including reasonable legal fees, we incur arising out of any breach by you of this user agreement, improper use of SwapIT Mobile or your breach of any law or the rights of a third party.

14. Termination

• You may terminate your account at any time by contacting support. We may terminate or suspend your account if you violate these T&Cs. Upon termination, your access to the app will cease, but your obligations under these T&Cs will remain in effect.

15. Changes to T&Cs

• We may update these T&Cs from time to time. We will notify you of any changes by posting the new T&Cs on the app. Your continued use of the app after changes are posted constitutes your acceptance of the new T&Cs.

16. Governing Law

• These T&Cs are governed by the laws of Pakistan. Any disputes will be resolved in the courts of Islamic republic of Pakistan.
